By accessing or using Postflare ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users, including individuals and organizations that create accounts, access the API, or otherwise use the Service.
Postflare is a transactional email sending platform built on Cloudflare infrastructure. The Service provides:
- A REST API and dashboard for sending transactional emails
- Domain verification and DNS management for email authentication
- Email delivery tracking and analytics
- Webhook notifications for email events
Postflare is designed for transactional and operational emails (e.g., password resets, order confirmations, notifications). It is not intended for bulk marketing emails.
To use the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials and API keys
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account.
You agree not to use the Service to:
- Send spam: Unsolicited bulk emails, including commercial messages sent without recipient consent
- Send phishing emails: Messages designed to deceive recipients into revealing personal information
- Distribute malware: Emails containing viruses, malicious code, or harmful attachments
- Send unauthorized bulk email: High-volume emails without proper recipient opt-in
- Harass or threaten: Messages that are abusive, threatening, or intended to intimidate
- Violate laws: Any activity that violates applicable local, national, or international law
We actively monitor for abuse. Accounts found in violation of this Acceptable Use Policy may be:
- Rate-limited or throttled
- Suspended with notice
- Terminated immediately for severe violations
You are responsible for ensuring your use of the Service complies with all applicable laws and regulations, including but not limited to:
- CAN-SPAM Act (United States)
- GDPR (European Union)
- CASL (Canada)
- Any other applicable anti-spam or data protection legislation
- Up to 100 emails per month
- Single verified domain
- Standard API access
- Higher monthly email limits
- Multiple verified domains
- Priority support
- Advanced analytics
- API requests exceeding your tier's rate limit will receive a
429 Too Many Requests response
- Email sending beyond your monthly allocation will be rejected until the next billing cycle
- We reserve the right to adjust limits to prevent abuse or maintain service quality
- API Key security: You are solely responsible for safeguarding your API keys. Treat them as sensitive credentials and never expose them in client-side code or public repositories.
- Rate limiting: Use the API responsibly. Implement exponential backoff for retries and respect rate limit headers.
- Versioning: We will provide reasonable notice before deprecating API versions. Breaking changes will be communicated at least 30 days in advance.
The Postflare name, logo, and branding are the intellectual property of Postflare. You may not use our branding without prior written consent.
Content you send through the Service remains your property. We do not claim ownership of your email content, templates, or data.
Open-source components of Postflare are licensed separately under their respective licenses.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee:
- 100% uptime or availability
- Delivery of every email to the recipient's inbox
- That the Service will be error-free or uninterrupted
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service
- Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
- We are not responsible for damages resulting from email delivery failures, including lost revenue, missed communications, or business disruption
You may terminate your account at any time through the dashboard settings or by contacting us. Upon termination:
- Your API keys will be immediately revoked
- Your data will be retained for 30 days, after which it will be permanently deleted
- Any outstanding payment obligations remain due
We may suspend or terminate your account if:
- You violate these Terms or the Acceptable Use Policy
- Your account has been inactive for more than 12 months
- We are required to do so by law
For non-urgent violations, we will provide 7 days' notice before termination. Severe violations (e.g., sending malware, phishing) may result in immediate termination without notice.
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service will be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction.
We may modify these Terms from time to time. When we make material changes:
- We will update the "Last updated" date and version number at the top of this page
- We will notify you via email at least 30 days before the changes take effect
- Your continued use of the Service after the effective date constitutes acceptance of the modified Terms
If you do not agree to the modified Terms, you must stop using the Service and close your account before the effective date.
